Uncontested Divorce

In Georgia, you  may be eligible for an uncontested divorce if:

  • Both spouses agree on all major issues, including the division of property and debts, child custody and visitation arrangements (if you have children), child support, and alimony.
  • At least one spouse must have been a resident of Georgia for at least six months before filing. 
  • Grounds for divorce are cited—most couples filing uncontested divorces use “irretrievably broken” as the reason, which doesn’t require proving fault.
  •  Both spouses must sign a settlement agreement outlining all the terms, a petition for divorce along with other required documents  must be filed
